TERMS AND CONDITIONS OF SERVICE

Welcome to Tondré Olé Speaks LLC. These Terms and Conditions of Service (the “Terms”) govern your use of the Tondré Olé Speaks LLC websites located at tondreole.com and tondreole.org (including our interactive website, the Clarity Compass), any of our current or future mobile applications (the “Apps”), and all related services, products, and digital content offered by Tondré Olé Speaks LLC (collectively, the “Services”).
Our websites, apps, and interactive features are collectively referred to as the “Platforms.” Your access to and use of the Platforms and Services are conditioned upon your acceptance without modification of these Terms, conditions, and notices contained herein. By using the Platforms or booking any Service, you agree to be bound by these Terms. Please read these Terms carefully, and keep a copy for your reference.
1. Mission and Products
Our mission is to promote and encourage the use of Tondré Olé Speaks LLC Services. We strive to provide our clients with a safe and professional experience. Our Products and Services include, but are not limited to: Public Speaking, Life Coaching, Consulting, Literature, Apparel, Digital Content, and other related services.
2. Privacy Policy
Your use of our Platforms is subject to Tondré Olé Speaks LLC’s Privacy Policy. Please review our Privacy Policy, which also governs the Platforms and informs users of our data collection practices.
3. Use of AI and Interactive Features
To enhance our Services, we may use Artificial Intelligence (AI) and other third-party technologies, particularly in our interactive features like the Clarity Compass. We are committed to your privacy and our promise of a “safe space”; we do not collect, share, archive, or sell any personal data, stories, or questions you may enter into our AI-powered interactive features. While we utilize third-party technologies, Tondré Olé Speaks LLC is not responsible for the data practices of these external entities or any potential misuse of information by them. However, should we be made aware of any such data abuse by a third-party service we employ, we are committed to informing our users.
4. Electronic Communications
Visiting our Platforms (tondreole.com, tondreole.org, or our Apps) or sending emails to Tondré Olé Speaks LLC and its associates constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically, via email, and on the Platforms, satisfy any legal requirement that such communications be in writing.
5. Your Account
If you use our Platforms and create an account, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that Tondré Olé Speaks LLC is not responsible for third-party access to your account that results from theft or misappropriation of your account. Tondré Olé Speaks LLC and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content at our sole discretion.
6. Children Under Thirteen
Tondré Olé Speaks LLC does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use our Platforms only with the permission of a parent or guardian.
7. Links to Third-Party Sites/Third-Party Services
Our Platforms may contain links to other websites (“Linked Sites”). The Linked Sites are not under the control of Tondré Olé Speaks LLC, and Tondré Olé Speaks LLC is not responsible for the contents of any Linked Site. Tondré Olé Speaks LLC is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Tondré Olé Speaks LLC of the site or any association with its operators.
8. No Unlawful or Prohibited Use/Intellectual Property
You are granted a non-exclusive, non-transferable, revocable license to access and use our Platforms strictly in accordance with these Terms of Use. All content included as part of the Service is the property of Tondré Olé Speaks LLC or its suppliers and protected by copyright and other laws. You agree to observe and abide by all copyright and other proprietary notices and will not make any changes thereto.
9. Third-Party Accounts
You may be able to connect your Tondré Olé Speaks LLC account to third-party accounts. By doing so, you acknowledge and agree that you are consenting to the continuous release of information about you to others (in accordance with your privacy settings on those third-party sites).
10. International Users
The Services are controlled, operated, and administered by Tondré Olé Speaks LLC from our offices within the USA. If you access the Services from a location outside the USA, you are responsible for compliance with all local laws.
LIFE COACHING SESSION BOOKING TERMS AND CONDITIONS
Please read these Terms and Conditions carefully before booking any coaching session. By proceeding with your booking, you agree to be bound by these specific Life Coaching Session Booking Terms and Conditions.
1. Services Offered
Tondré Olé Speaks LLC provides professional life coaching services via phone and Zoom. These services are designed to support clients in achieving personal and professional goals. Life coaching is not a substitute for therapy, counseling, or medical diagnosis.
2. Eligibility
By booking a session, you confirm that you are at least 18 years of age.
3. Booking and Payment
- a. Booking Process: All sessions must be booked through our online scheduling system.
- b. Payment: Full payment for coaching sessions is required at the time of booking. Discovery Calls are complimentary.
- c. Confirmation: You will receive an email confirmation with your session details.
4. Rescheduling and Cancellations
- a. Client Rescheduling: You may reschedule up to twenty-four (24) hours before your session without penalty.
- b. Client Cancellations: Cancellations with more than 24 hours notice receive a full refund. Cancellations with less than 24 hours notice and no-shows will result in forfeiture of the full session fee.
- c. Coach Cancellation: In the rare event we need to cancel, you will be offered a reschedule or a full refund.
5. Client Responsibilities
You are responsible for your punctuality, being in a private environment, and ensuring your technical equipment works for Zoom sessions.
6. Confidentiality
All individual coaching sessions are strictly confidential, except where there is a legal obligation to disclose information (e.g., threat of harm).
7. Disclaimer of Warranties; Limitation of Liability
Tondré Olé Speaks LLC cannot guarantee specific outcomes or results. Your progress depends on your own commitment and effort.
8. Intellectual Property
All materials provided during coaching sessions are the intellectual property of Tondré Olé Speaks LLC and are for your personal use only.
9. Termination of Services
We reserve the right to terminate coaching services with any client at any time, with written notice. Any unused, pre-paid session fees will be refunded.
GENERAL PROVISIONS APPLICABLE TO ALL SERVICES
1. Indemnification
You agree to indemnify, defend and hold harmless Tondré Olé Speaks LLC, its officers, directors, employees, agents, and third parties, for any losses, costs, liabilities, and expenses relating to or arising out of your use of the Platforms or Services.
2. Arbitration
Any dispute arising from these Terms shall be resolved by final and binding arbitration pursuant to the Federal Arbitration Act.
3. Class Action Waiver
Any arbitration will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted.
4. Liability Disclaimer (General)
THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TONDRÉ OLÉ SPEAKS LLC BE LIABLE FOR ANY DAMAGES ARISING OUT OF THE USE OR PERFORMANCE OF THE PLATFORMS.
5. Termination/Access Restriction
Tondré Olé Speaks LLC reserves the right to terminate your access to the Platforms and Services at any time, without notice. This agreement is governed by the laws of the State of New Jersey.
6. Changes to Terms
Tondré Olé Speaks LLC reserves the right to change the Terms under which its Services are offered. The most current version will supersede all previous versions.
